Elizabeth Gallagher

Elizabeth is contributing the chapter on the MoJ Process to Binghams’ Personal Injury and Motor Claims Cases (2023).

She specialises in personal injury law and related areas (motor insurance fraud, inquests and inquiries, costs and litigation funding, health and safety, and insurance).

She accepts instructions on behalf of both Claimants and Defendants, and has experience encompassing a wide range of areas of personal injury law, including employers’ liability; occupiers’ liability; highway accidents; road traffic accidents; product liability; landlord’s liability for defective premises and travel claims. She also has experience of group litigation.

She is an experienced and confident advocate, who represents parties at trial and in the full range of interim hearings (including applications and costs and case managements hearings). She also has a busy paperwork practice, advising on liability, quantum, evidence and procedure, as well as drafting pleadings and schedules of loss.

Elizabeth is able to advise on all aspects of litigation – including limitation, liability, evidence and quantum, either at conference or in writing. She also appears in applications involving procedural issues such as relief from sanctions, costs arguments and limitation.

She is regularly instructed in Multi-Track cases and is confident dealing with expert medical evidence across a range of fields. She is experienced at dealing with (amongst others) serious orthopaedic injuries including amputations, burn injuries and serious scarring, long-term psychiatric disorders and pain conditions.

She is familiar with dealing with sensitive, high-profile matters, having been instructed in the Hillsborough Victims Litigation and being currently instructed on the Grenfell Tower Inquiry.
