Vaibhav Adlakha

Vaibhav is an extremely motivated multi-lingual legal professional with a passion for international and business issues. After finishing schooling (2004) from The American School of The Hague, he completed his university studies from Warwick University (2007) and BPP Law School (2008) in the UK. He also did an Advanced Masters in Air and Space Law from Leiden University in the Netherlands (2010). From 2010 ' 2014, he worked with the Netherlands Competition Authorities, Unilever, the Dutch Ministry of Infrastructure and Environment, HiiL Innovating Justice and Global Human Rights Defence. He joined Reed Smith LLP as a Trainee Solicitor in August 2016. During training he worked in Shipping Admiralty, Banking and Finance, EU Competition, and Financial Regulation. In September 2018, he qualified as an Associate in the EU Competition department, handling Public Procurement, State Aid as well as some Financial Regulation issues among others. His strengths lie in business acumen, analysing and synthesizing information, innovative thinking, and effective communication. He has enjoyed contributing to Client Alerts on various issues. He is actively involved in and has a passion for Diversity Inclusion initiatives. He is an active member of Reed Smith LEADERS Group which champions disability and diversity projects. He has contributed towards Blogs and Newsletters of many organisations such as My Kinda Future, EmployAbility and InterLaw Diversity.

This Practice Note considers how firms can prevent a potential regulatory breach from escalating to a serious issue subject to FCA and/or PRA enforcement. It considers the risks for firms and senior managers of not notifying or reporting a breach to the regulator. It sets out the practical considerations for firms on discovering a breach, including: planning and strategy in relation to internal investigations; dealing with individual misconduct; securing evidence; the role of senior managers when a breach occurs; notifications to the market under LR 9.2; informing other parties of a breach such as insurers and auditors; publicity and public relations (PR) strategy; and further consequences of breaches such as civil proceedings and interest from other regulators.
