Suzanne Prescott

Solicitor, Kennedys
I am a Solicitor in private practice specialising in employers’ and public liability claims for defendants, principally local authorities and insurers. I provide technical, strategic and tactical advice on complex breach of duty, causation and/or quantum issues including catastrophic loss, pain syndromes, psychiatric and traumatic brain injury, and paralysis, arising from a diverse range of circumstances. I am an experienced litigator with a solid record of trial success, including at the Court of Appeal, with a particular interest in fraudulent and exaggerated claims across all areas of practice.

I qualified in 1999, and in 2011 obtained a Post Graduate Certificate in Education following a teaching placement at a Sixth Form College on AS/A2 Contract Law.  I mentor and support Trainee Solicitors and Legal Apprentices across all stages of their training.

Practice notes

This Practice Note covers the essentials of employers’ liability insurance (EL). The Employers’ Liability (Compulsory Insurance) Act 1969 makes employers’ liability insurance compulsory for every employer in the UK for bodily injury and disease sustained by employees. Subcontractors do not need to be covered by an insured’s employers’ liability policy. The Employers’ Liability (Compulsory Insurance) Regulations 1998 are discussed, as are common conditions and exemptions to cover. EL policies are often written on a ‘claims occurring’ basis, but this may differ when dealing with industrial claims, such as disease due to asbestos exposure. This Practice Note discusses the application of the Third Parties (Rights Against Insurers) Act 2010, and provides tips on risk management and a checklist for employers to consider.
