Product description
Why should you buy Unjustified Enrichment
The title analyses the general principle of Unjustified Enrichment and the elements of a claim following the revolutionary trilogy of cases, Morgan Guaranty, Shilliday and Dollar Land, in the 1990s. The boundaries of this area of law are discussed, as is terminology, and its interface with Criminal Law, Public Law and Property Law. The work clearly references Scots Law and its civil law principles, and developments in English Law with difference of approach between the two jurisdictions being discussed.
The title makes a significant contribution to the legal literature on this increasingly important and dynamic area of the law, presenting Unjustified Enrichment as a potential basis of claim across a wide range of commercial transactions as well as being relevant to many areas of private law. The title surpasses in its range and depth of analysis existing texts and it is the highlight of our 2021-22 Scottish Law publishing schedule.
