Multi-track—case management—checklist This checklist is based on what is required for a case proceeding on the multi-track under CPR 29 and CPR PD 29 (which deal with case management in the multi-track). It should be read in conjunction with Practice Notes: Multi-track—case management and Multi-track—case management conference (CMC), which give guidance on case management generally and case management conferences (CMCs) in the multi-track. This Checklist sets out a broad overview of some of the case management issues to be considered and addressed early in proceedings and before any CMC is held. It is not a definitive list and you will need to consider each of the issues in more detail as relevant to the facts of the specific case. Dispute Resolution analysis: The minutes of the CPR Committee (CPRC) meeting of 7 February 2025 (conducted in a hybrid format at The Rolls Building (Royal Courts of Justice) and via video conference) cover a number of issues including Extended Fixed Recoverable Costs, Fixed Costs Medical Reports, amendments to CPR PD 52D, and to CPR 8.5, the Lacuna Sub-Committee, Costs Budgeting Lite (Civil Justice Council Costs Report) and the Litigant in Person hourly rate.

Relief refused against strike out for non-compliance with security for costs unless order (Sinclair v Dorsey & Whitney)

Dispute Resolution analysis: The Commercial Court has dismissed an application under Rule 3.9 of the CPR for relief from the strike out of a £30m claim following the claimants’ failure to comply with an unless order to provide security for costs. In doing so, it applied the three stages of Denton and considered, among other things, the breach to have been ‘very’ serious and that, although the ‘very severe prejudice’ to the claimants of not being able to pursue their high value claim was an ‘important consideration’, it was not ‘sufficient to warrant the grant of relief from sanctions’. Further, the court spoke of the 'very powerful public interest in ensuring that parties recognise the importance of complying with unless orders'. This judgment offers useful guidance to practitioners on the application of CPR 3.9, Mitchell and Denton as well as guidance on proposing alternative means of security (in this case by means of an after the event (ATE) insurance policy) to those set out in the security for costs order.
