How to conduct a health and safety risk assessment Having in place a well-thought-out and accessible structure on health and safety could help enable an organisation to ensure that it is managed effectively and efficiently. Some elements of health and safety, such as assessing (and controlling) the risks in your workplace are required by law. An organisation should therefore: • identify its overriding principles and objectives to ensuring the health and safety of its key stakeholders, ie what it wants to achieve (see subtopic: Health and safety policy) • identify key members of staff and obtain their input • conduct a risk assessment • formulate an action plan justifying what the organisation needs and why (see Practice Note: How to formulate a health and safety plan) • implement the plan, and • review the plan This Practice Note provides information on conducting a health and safety risk assessment in an office-based workplace. Accidents caused by the provision of personal protective equipment Post 1 October 2013 On 1 October 2013, section 69 of the Enterprise and Regulatory Reform Act 2013 (ERRA 2013) came into force. For workplace accidents occurring from that date, civil liability no longer arises from a breach of statutory duty unless the relevant regulation provides for it. The Personal Protective Equipment at Work Regulations 1992, SI 1992/2966 do not provide for civil liability to arise from a breach. In the circumstances, claimant practitioners will be left to rely on a breach of a regulation as support for a claim in negligence. While it will no longer be appropriate to base a claim on the breach of a regulation, claimant practitioners are very likely to still refer extensively to the relevant statutory provisions (or at least recite what they say) as setting out the standards of care expected.
