GLOSSARY

Plagium definition

What does Plagium mean?

In common law, the theft of a child from his or her parents or guardians.

Plagium, as an aggravated form of theft, is a criminal offence. It is the deliberate taking of a child under the age of puberty from the custody of a parent or other person having the parental right of custody under statute or by court order. For a discussion of some of the differences between a charge of plagium and a charge of child abduction, see Brouillard v HM Advocate 2004 J.C. 176.
