JCT 2024 contracts—good faith in practice
Construction analysis: In this Insight, Shy Jackson considers the scope and implications of the parties’ obligation to work together in good faith under the Joint Contracts Tribunal (JCT) 2024 contracts.
A party wall can be defined as a boundary wall which sits half on one property, and half on another and is therefore a jointly owned wall. However, a party wall may also be a wall which sits on one property but abuts another.
The relevant piece of legislation which affects party walls is the Party Wall etc Act 1996 (PWA 1996). PWA 1996 affects owners who wish to work on existing party walls and structures, who wish to construct a new wall which sits at or astride a boundary with another property or who wish to excavate close to the boundary.
