Incomplete offences

Incomplete offences

There may be circumstances where a defendant fails, for one reason or another, to commit a complete offence. For example:

•
he may be interrupted in the commission of an offence
•
his participation may amount to encouraging the commission of an offence by another, or
•
he may be party to an agreement with at least one other person to commit an offence.

It is not necessary for a full offence to have been committed for a prosecution to take place in these circumstances as a defendant may be guilty of an offence on the basis of:

•
attempt
•
encouraging or assisting a crime, or
•
conspiracy.

Incomplete offences always relate to a substantive offence and cannot be charged on their own. Therefore, an indictment must be drafted with reference to the complete offence, eg conspiracy to murder or attempted wounding. See Practice Note: The indictment.

Most incomplete offences should not be mixed together, eg it is not an offence to attempt to conspire.

FCDO announces 13 new Global Anti-Corruption sanctions designations

The Foreign, Commonwealth and Development Office (FCDO) and the Office of Financial Sanctions Implementation have announced 13 new entries under the Global Anti-Corruption Sanctions Regulations 2021, SI 2021/488. The designations target individuals and entities in Moldova, Georgia and Guatemala involved in corruption, including the pro-Kremlin Evrazia organisation, two Georgian judicial officials and seven Guatemalan officials including former President Giammattei. The sanctions impose asset freezes and UK travel bans on the designated persons.

CMA fines car manufacturers £77.6m for recycling competition law breaches

The Competition and Markets Authority (CMA) has fined ten car manufacturers, including BMW, Ford, Jaguar Land Rover, Peugeot Citroen, Mitsubishi, Nissan, Renault, Toyota, Vauxhall, and Volkswagen, along with two trade bodies, over £77m for breaching competition law related to vehicle recycling and advertising claims. These manufacturers illegally agreed not to compete in advertising the recyclability of their vehicles and colluded to avoid paying third parties for recycling customers’ scrap cars. Mercedes-Benz, which was also involved in these agreements, is exempt from penalties as it informed the CMA of its participation under the authority’s leniency policy. The European Commission conducted a parallel investigation in 2022 and has now imposed fines for violations of EU law.

Supreme Court confirms Crown Court’s jurisdiction to re-try a defendant despite procedural non-compliance (R v Layden)

The Supreme Court in R v Layden, in allowing the prosecution’s appeal, has confirmed that a failure to comply with the procedural requirements in section 8(1) of the Criminal Appeal Act 1968 (CAA 1968) does not deprive the Crown Court of its jurisdiction to re-try a defendant. This decision overturns R v Llewelyn in which the Court of Appeal had quashed the defendant’s conviction due to the failure to arraign him within the two month requirement, stating that such a failure resulted in the invalidity of the retrial proceedings. Although the Supreme Court emphasised that the procedural requirements in CAA 1968, s 8 must be followed, it stated that non-compliance should not deprive the Crown Court of the jurisdiction to re-try a defendant. ‘Total invalidity’, as stated by the court, fundamentally risks bringing the justice system into disrepute as it undermines the purpose of CAA 1968, s 7. The National Crime Agency and Lord Hanson, the Fraud Minister, emphasise the importance of public-private partnerships to disrupt scammers and protect the public.
