Health and safety obligations

In the acquisition of a manufacturing business or company, health and safety issues can be significant. Non-compliance with health and safety laws and workplace accidents can result in corporate and personal liabilities, employee claims, capital expenditure and reputational damage.

Most businesses will have a variety of health and safety duties. These can include general health and safety obligations (policy statement, risk assessments, competent person, training etc), specific health and safety obligations (such as fire safety, machinery safety, accident reporting) and health and safety obligations that cross over with environmental protection (eg asbestos in buildings and storing and handling oil and chemicals).

UKGBC responds to DEFRA consultation on strategic Land Use Framework

The UK Green Building Council (UKGBC) has submitted its response to the Department for Environment, Food and Rural Affairs (DEFRA) consultation on the Land Use Framework, which aims to establish England's first strategic approach to land use. The response advocates for mandatory urban greening targets in local plans, including the implementation of a 3:30:300 goal for urban green spaces, integration of blue-green infrastructure, and expansion of urban food growing spaces. UKGBC cites Natural England data showing parks and greenspaces deliver £6.6bn in annual benefits across health, climate and environmental outcomes.

DESNZ launches GGR and BECCS revenue support consultation

The Department for Energy Security and Net Zero (DESNZ) has launched a consultation on revenue support regulations for greenhouse gas removals (GGRs) and power bioenergy with carbon capture and storage (BECCS) business models. The consultation seeks views on four key areas: direction to offer to contract, publication of information, counterparty functions and eligibility requirements. Running from 28 April to 9 June 2025, the consultation seeks views from project developers, voluntary carbon market stakeholders, Emission Trading Scheme participants, financial investors and trade associations. DESNZ has published a 29-page consultation document outlining the proposed regulatory framework.

Commission proposes directive to implement High Seas biodiversity treaty into EU law

The European Commission has presented a proposal on 25 April 2025 to integrate the Biodiversity Beyond National Jurisdiction (BBNJ) Agreement into EU law. The directive aims to implement provisions for marine protected areas, environmental impact assessments, and genetic resource sharing in international waters. The proposal will be discussed by the European Parliament and Council, with implementation required before the BBNJ Agreement takes effect—scheduled for 120 days after 60 countries ratify. The EU plans to ratify before the UN Ocean Conference in June 2025.

DESNZ announces approval for Eni's £2bn Liverpool Bay carbon capture project

The Department for Energy Security and Net Zero (DESNZ) has announced that Eni has finalised a £2bn deal for the Liverpool Bay Carbon Capture and Storage (CCS) project spanning north Wales and north west England. The North Sea Transition Authority (NSTA) has awarded three carbon storage permits to Eni for the project. The development forms part of the government's £21.7bn commitment to establish a CCS industry, following the East Coast Cluster project approved in December 2024. The project aims to create 2,000 construction jobs and will establish infrastructure to decarbonise industries including waste management, hydrogen and cement production. Additionally, the government has announced planning reforms intended to streamline approval processes for clean power projects including solar, wind and nuclear installations.
