Health and safety obligations

In the acquisition of a manufacturing business or company, health and safety issues can be significant. Non-compliance with health and safety laws and workplace accidents can result in corporate and personal liabilities, employee claims, capital expenditure and reputational damage.

Most businesses will have a variety of health and safety duties. These can include general health and safety obligations (policy statement, risk assessments, competent person, training etc), specific health and safety obligations (such as fire safety, machinery safety, accident reporting) and health and safety obligations that cross over with environmental protection (eg asbestos in buildings and storing and handling oil and chemicals).
