IP essentials

The IP essentials subtopic provides a basic overview of IP law. It is aimed at commercial lawyers not specialised in IP.

What is intellectual property?

The World Intellectual Property Office defines IP as ‘creations of the mind, such as inventions; literary and artistic works; designs; and symbols, names and images used in commerce’. Broadly, the aim of IP law is to cultivate an environment in which creativity and invention can flourish.

In the UK, IP rights are registered with the Intellectual Property Office (IPO) though there are other entities which register rights at an international level.

The four most common IP rights are: patents, trade marks, designs and copyright. Other available IP rights and associated rights include: database rights, plant variety rights, semiconductor topography rights, geographical indications, trade secrets, confidential information and know-how. There are rights to prevent passing off and protection may also be available for spare parts and image rights.

DfE announces £37m funding for 300 new school-based nurseries

The Department for Education (DfE) has announced the approval of 300 new school-based nurseries across England with funding of £37m for the first phase of the programme. The initiative seeks to create up to 6,000 new nursery places, with up to 4,000 available from September 2025. This initiative is part of a broader £2bn investment in early years education for 2026, which includes the provision of 30 government-funded childcare hours intended to reduce costs for parents. The DfE reports that the scheme aims to save families up to £7,500 annually through funded hours and £450 through free breakfast clubs.

Regulator of Social Housing updates rent standard guidance for 2025-2026

The Regulator of Social Housing (RSH) has published updated guidance on annual rent increases for registered social housing providers, effective from April 2025. The update follows December 2024's publication of limits on annual rent increases for 2025-2026. The guidance operates alongside the 2020 Rent Standard, which resumed full application from 1 April 2024 following the end of the temporary 7% ceiling on increases that was in place during 2023-2024. The updates include adjusted tables for calculating permitted rent increases and maintain provisions for exemption applications from private registered providers.

DfE announces £302m FE college condition allocation guidance for 2025-2026

The Department for Education (DfE) has published guidance detailing the £302m further education (FE) college condition allocation for 2025-2026. The funding package, available to all FE colleges and designated institutions in England, aims to support capital projects and estate maintenance. The publication includes detailed spending guidelines, allocation methodology and individual institution funding amounts. The guidance outlines eligible spending categories focused on addressing and preventing estate deterioration.
