Service occupancy and service tenancy

The status of an employee’s occupation of a property or accommodation, and the methods of terminating such occupation will depend upon a number of factors, including whether the occupation is required for the better performance of the employee’s duties and whether it is an express term of the employee’s contract of employment.

Service occupancy

A service occupancy is a form of licence which will arise where:

  1. it is essential that the employee lives in particular accommodation or in a particular vicinity for the better performance of their duties, or

  2. it is an express term of the employee's contract of employment that they live in a particular residence from where
