Common law tenancies

Common law tenancies are tenancies that do not fall within any of the statutory security of tenure regimes. These include, for example, the Rent Act 1977, Housing Act 1985 or Housing Act 1988 (on which, see: Private residential tenancies—overview, Assured and assured shorthold tenancies—overview and Public sector residential tenancies—overview).

The requirements for termination of a common law tenancy and to recover possession differ, depending upon whether the common law tenancy is fixed term or periodic.
