What is a profit à prendre?

A profit à prendre is a right to take natural resources from another person’s land. Examples of profits include:

•
parts of the land itself such as sand, peat or minerals
•
products growing on the land such as grass or timber—this includes grazing rights
•
wild animals such as fish or game

The products taken must be capable of ownership so there cannot be a profit of water (unless it is contained in a tank or other receptacle).

BPF publishes commentary on Net Zero Pledge

The British Property Federation (BPF) has published a blog post as part of its Spotlight Series, highlighting its Net Zero Pledge, an initiative aimed at fostering collaboration and accelerating decarbonisation efforts within the UK real estate sector. The Pledge calls on members to commit to achieving net zero carbon emissions by 2050, actively engage with other signatories, and share insights to support the industry's transition. With signatories representing approximately £125bn in UK assets under management, the initiative addresses the significant environmental impact of buildings, which contribute around 25% of the UK’s greenhouse gas emissions. The BPF has also taken the Pledge, partnering with Planet Mark to develop its own net zero targets and plans.

Law Commission launches consultation on right to renew business tenancies

The Law Commission has launched a consultation to examine how the right to renew business tenancies under Part 2 of the Landlord and Tenant Act 1954 (LTA 1954) functions and whether it meets the needs of business tenants and landlords. The consultation seeks to assess the efficacy of the current ‘contracting out’ model and explore alternative models, including mandatory security, the abolition of security of tenure, and a ‘contracting-in’ approach. It also examines which types of business tenancies should benefit from security of tenure. The consultation closes on 19 February 2025, with a second consultation paper expected to follow based on the responses received.

HMLR publishes blog post on property fraud prevention measures

HM Land Registry (HMLR) has published a blog post, outlining its efforts to combat property fraud and educate the public on preventative measures. The post highlights that HMLR prevented over £340m worth of property fraud between 2009 and 2023, including more than £123m in registered title fraud over the past five years. HMLR also noted its free Property Alert service, which notifies property owners of certain register activities, and discusses the option of applying for a Form LL restriction to safeguard against identity theft-based fraud. It also details HMLR's property fraud hotline and relevant provisions in the Land Registration Act 2002 (LRA 2002) for rectifying the register or providing compensation in cases of fraud.

HMLR highlights progress of PropTech start-up Viability

HM Land Registry (HMLR) has published a blog post, highlighting the progress of Viability, a property technology (PropTech) startup that participated in the Geovation Accelerator Programme in 2023. Viability has developed a platform that utilises HMLR data to automate and expedite the assessment of potential housing development sites. Since completing the programme, the company has gained over 100 active users, conducted more than 1,000 viability assessments, and secured over £500,000 in funding.
