This subtopic deals with the law and regulation governing sponsorship, including information about ambush marketing as well as image rights.

Brands are increasingly looking to align themselves with events or content that consumers care about. For this reason sponsors are increasingly aligning themselves with areas outside of the traditional sports sponsorship model, for example there has been significant growth in sponsorship of music events and artists, sectors that brands traditionally shied away from due to the myriad of rights owners.

Ofcom announces enforcement programme initiative to monitor compliance with OSA 2023

Ofcom has announced its enforcement programme initiative to monitor compliance with the illegal content risk assessment duties and record keeping duties under sections 9, 23, 26 and 34 of the Online Safety Act 2023 (OSA 2023). The initiative follows the publication of the Risk Assessment Guidance and Risk Profiles by Ofcom in December 2024 to assist providers in meeting these duties. The programme is expected to run for at least 12 months, during which Ofcom may open formal investigations for non-compliance.

ICO launches investigations into social media platforms' use of children's data

The Information Commissioner's Office (ICO) has announced investigations into how TikTok, Reddit, and Imgur use the personal information of UK children. The investigation into TikTok focuses on how the platform uses the personal data of children aged 13–17 to make recommendations and deliver content, amid concerns about children being exposed to inappropriate or harmful content. The investigations into Reddit and Imgur examine their age assurance measures and use of children's personal information. These investigations are part of broader efforts to ensure social media platforms protect children's privacy and comply with data protection laws. The ICO has also published a progress update on its Children’s code strategy, outlining its key interventions in this space, and including a comparison table of some of the privacy practices of 29 social media and video sharing platforms.

European Parliament examines EU AI Act-EU GDPR tensions on algorithmic discrimination

The European Parliament has highlighted the challenges posed by Regulation (EU) 2024/168 (EU AI Act), which entered into force in August 2024, in mitigating discrimination in high-risk AI systems while respecting fundamental rights, including data protection. The EU AI Act allows processing special categories of personal data to detect and correct bias, but its interplay with Regulation (EU) 2016/679 (EU General Data Protection Regulation (EU GDPR)), which is more restrictive, creates legal uncertainty. Legislative reform or further guidance may be needed to clarify these issues.

UK Parliamentary Committees urge government to rethink AI and copyright proposals

Two cross-party committees, the Culture, Media and Sport Committee and the Science, Innovation and Technology Committee, have responded to the UK government's consultation on artificial intelligence (AI) and copyright. They emphasise the need for fair remuneration for creators and call for improved transparency in AI data usage. The committees oppose the government's proposal for an 'opt-out' approach to AI training data, citing the lack of technical measures to enforce it. They urge the government to publish full impact assessments and ensure compliance mechanisms are in place.
