Despite divisive political rhetoric, DEI is alive and well

Law360: DEI is dead. Long live DEI. Findings in the World Economic Forum report published in January 2025 raise the question of whether reports of the death of diversity, equity and inclusion (DEI) are, in fact, exaggerated. Christine Young, partner and Joshua Peters, associate at Herbert Smith Freehills LLP discuss the current position of DEI initiatives and the possible direction of travel in 2025 in the UK and US, and set out some tips for employers in light of the EU Pay Transparency Directive and the UK government’s proposed Equality (Race and Disability) Bill.

Amendments to the Employment Rights Bill

Employment analysis: The Employment Rights Bill (ERB) completed its Committee stage in the House of Commons on 17 January 2025, and an amended version of the Bill was published on 27 January 2025. The amendments to the Bill are varied and include the addition of Statutory Sick Pay measures for Northern Ireland, the inclusion of a chapter in relation to seafarers, an extension to the time limit for bringing employment tribunal claims and amendments relating to an employer’s duty to make a guaranteed hours offer, the requirements for withdrawing such offers and tribunal powers to make awards for breaches. The Bill is now set for the Report stage of its progress through Parliament.

Law360, London: Nearly half of employers in the legal sector are paying interns less than the national minimum wage—or nothing at all, widening the gap between middle-and working-class graduates who want access to internships, a new study has found.

DBT confirms implementation of Neonatal Care Leave and Pay from April 2025

The Department for Business and Trade (DBT) has confirmed the implementation of Neonatal Care Leave and Pay will be effective from 6 April 2025, subject to Parliamentary approval. This new entitlement, stemming from the Neonatal Care (Leave and Pay) Act 2023, will allow eligible parents to take up to 12 weeks of additional leave when their baby is admitted to neonatal care within 28 days of birth and remains in hospital for at least 7 consecutive days. Neonatal leave will be a day one right for employees, with Statutory Neonatal Care Pay available to those meeting continuity of service and minimum earnings requirements. The measure forms part of the government's wider reform to employment law which is set to be implemented through the Employment Rights Bill.
