Advance decisions

An individual has always had the freedom, under common law, to determine in advance whether or not to undergo medical treatment and, prior to the introduction of the Mental Capacity Act 2005 (MCA 2005), any statement to this effect was known as a 'living Will'. MCA 2005 has put the concept of the living Will into a statutory context as an advance decision. The relevant legislation is contained in MCA 2005, ss 24–26 and this should be read alongside Chapter 9 of the MCA 2005 Code of Practice.

Privy Council rules BVI company shares are not immovable property (Al Thani v Al Thani)

Supreme Court confirms application of immovables rule to English property

The Supreme Court has unanimously dismissed Ms Kireeva’s (Russian bankruptcy trustee’s) appeal to overturn the Court of Appeal’s’ decision regarding matters arising out of the bankruptcy of Mr Bedzhamov. UT finds FTT made errors when setting aside HMRC best judgment assessment (HMRC v Sintra Global)

Tax analysis: In Sintra Global, the Upper Tribunal (UT) set aside the decision of the First-tier Tax Tribunal (FTT) insofar as it related to a notice HMRC had issued to an individual making him liable for the payment of a civil evasion penalty charged against a company he was a director of. The UT found that the FTT had failed to follow the guidance provided by the Court of Appeal in Pegasus Birds in relation to the assessment the penalty was based on.
