This week's edition of Restructuring & Insolvency weekly highlights includes: an analysis of the extent of the insolvency courts’ jurisdiction (Advanced Security Alarm Protection Ltd v UK Protection Ltd), an examination of when a winding-up petition is considered to have been ‘presented’ (Re A Company), a discussion of a case where a director was found liable for fraudulent trading, wrongful trading and misfeasance and ordered to pay the costs and expenses of the liquidations (Re Stacks Living Ltd (in liquidation)), plus a round-up of other news and cases for restructuring and insolvency professionals.

Insolvency service announces closure of UK firm for defrauding German consumers

The Insolvency Service reports on the shutting down of Advantia Card Ltd (registered in the UK) for supplying German consumers with fraudulent prepaid cards without their prior consent, followed by demands of repayment through employing the services of a debt collection agency. The firm received more than 190 grievances from members of the public in Germany and following investigations conducted by the Federation of German Consumer Organisations, was shut down on 28 January 2025 after a hearing at the High Court in London.

New Practice Notes—Part 26A restructuring plan deal debriefs

Restructuring & Insolvency analysis: The LexisNexis Restructuring & Insolvency practical guidance team has published two new Practice Notes in their ‘Restructuring Plan deal debrief series’. The Practice Notes include deal debriefs relating to restructuring plans (RP) filed under Part 26A of the Companies Act 2006. They set out various metrics for each Part 26A restructuring plan, including: the timeline, the restructuring terms, any third party releases, the classes formed, voting in each class, governing law, any challenges (and whether from out of the money creditors), returns under the relevant alternative compared to under the RP, shareholders’ retention of equity, whether cross class cramdown was used and the ultimate result (where available).

Insolvency Service reports director disqualification for BBL fraud

The Insolvency Service has announced the ten-year directorship ban on Azizullrahman Akbari, the former director of New Watan Bakery Limited, for exploiting the coronavirus bounce back loan (BBL) scheme. Akbari fraudulently secured the maximum £50,000 loan by significantly exaggerating his company's turnover and entered liquidation in July 2023 with outstanding debts surpassing £53,000.
