Irish DPC’s engagement with AI model providers boosted with EU’s opinion

MLex: The Irish Data Protection Commission has welcomed an opinion by an umbrella group of EU data protection authorities on AI providers' use of personal data to train AI models. The opinion will support the authority's ‘engagement with companies developing new AI models before they launch on the EU market, as well as the handling of the many AI-related complaints that have been submitted’, DPC Commissioner Dale Sunderland said in a statement.

Commission seeks feedback on Apple's EU DMA interoperability measures

The European Commission has issued preliminary findings to Apple regarding two specification proceedings under the EU Digital Markets Act (DMA). The Commission has proposed measures for Apple to ensure interoperability of connected devices with iPhones and to enhance transparency in third-party interoperability processes. The Commission aims to enforce Apple's obligation to provide free and effective interoperability with iOS and iPadOS features, as mandated by the DMA. Two public consultations have been launched, seeking feedback on these measures until 9 January 2025.

OpenAI, X, Google can use legitimate interest for AI models, EDPB says

MLEX: OpenAI, X, Google and Meta will be able to use legitimate interests as a legal basis for processing personal data for developing and deploying AI models provided that adequate mitigation measures are in place, the European Data Protection Board (EDPB) said in an influential opinion today. The EDPB opinion also touched upon how to address unlawful data processing for AI model development, and in what circumstances AI models can be considered anonymised.

Irish DPC fines Meta €251M for GDPR violations in 2018 data breach

The Irish Data Protection Commission (DPC) has imposed a €251m fine on Meta Platforms Ireland Limited following two inquiries into a 2018 data breach affecting 29 million Facebook accounts globally. The DPC found infringements of Regulation (EU) 2016/679 (GDPR) Articles 33(3), 33(5), 25(1), and 25(2), relating to breach notification, documentation, and data protection by design and default. The decision highlights the importance of integrating data protection requirements throughout system development to prevent serious risks to individuals' fundamental rights and freedoms.
