Civil procedure rule committee minutes

The Civil Procedure Rules Committee (CPRC) is a non-departmental public body set up under the Civil Procedure Act 1997 to make the rules of court for the Civil Division of the Court of Appeal, High Court and the County Court. The committee meets on a regular basis throughout the year to discuss and work through changes to the Civil Procedure Rules (CPR) and associated Practice Directions.

This subtopic provides a summary—with links through to more detailed analysis—of minutes of the approved meetings of the CPRC and OPRC.

The rules referred to in the minutes of the meetings set out below were in force at the time of those meetings but may have changed or been omitted since.

Court orders parties to attempt mediation (DKH Retail Ltd v City Football Group Ltd)

Dispute Resolution analysis: This decision considers an application by the claimants for the court to order the parties to mediate their dispute pursuant to the courts’ powers to do so in CPR 1.4(2)(e) and CPR 3.1(2)(o), following the leading Court of Appeal decision of Churchill v Merthyr Tydfil County Borough Council in which the Court of Appeal determined that courts have the power to order parties to engage in a non-court based dispute resolution process.

This week's edition of PI & Clinical Negligence weekly highlights includes the updated set of Additional Tables to the Ogden Tables which have been published to provide multipliers at positive 0.5%. We consider a County Court decision which dismissed a claim for personal injury due to fundamental dishonesty but the claims for vehicle damage, recovery and storage and for loss of use were not dismissed. We have also included a new Practice Note which provides guidance on military noise-induced hearing loss claims. In addition, we have our usual roundup of other news, cases and New Law Journal articles of interest.

Fundamental dishonesty and the road to justice—the surprising outcome (Senay v Mulsanne Insurance Company Ltd)

PI & Clinical Negligence analysis: This was an RTA involving a mixed claim for personal injury and losses caused by negligence (directly or indirectly related to the accident). The claim succeeded on the issue of liability. Having decided that the personal injury claim was fundamentally dishonest, the court was invited to dismiss the entire claim—including claims for recovery and storage of the vehicle after the accident and damages for loss of use. The issue being the reach and effect of section 57 of the Criminal Justice and Courts Act 2015 (CJCA 2015) in claims which are for personal injury as part of a larger claim. Because the judge held there was no binding authority or guidance on the point, the court conducted an analysis of the wording of the 2015 statute, by reference to Hansard, to determine the intention of the legislature. Official Injury Claim publishes quarterly service data

The Official Injury Claim has published its quarterly service data for the period of 1 October to 31 December 2024. This latest release includes comprehensive statistics on various aspects of the claims process, such as claims volume, representation, types of claims, settlements and liability. Notably, the publication now features additional data on the top five reasons for calls to the Portal Support Centre, enhancing transparency and providing valuable insights into user interactions. The report also covers exceptional injuries and circumstances, claims exiting the portal, lifecycle and dormancy. This expanded dataset aims to offer a more thorough understanding of the service's operations and will continue to be issued on a quarterly basis, serving as a crucial resource for legal practitioners and stakeholders in the personal injury claims sector.
